HURRICANE — Notice is hereby given to all interested persons that on Tuesday, the Washington County Commission adopted a resolution proposing amending the boundary of the Hurricane Valley Fire Special Service District to include the corporate limits of the city of Hurricane. The resolution provides for the holding of a public hearing on the proposed boundary amendment.
The public hearing shall be held Aug. 18 at 5 p.m. at the Hurricane City Council chambers, located at 147 N. 870 West, Hurricane. The Washington County Commission will hear all interested persons and entity representatives desiring to be heard and will give full consideration to all protests presented. Additionally, any interested person may protest the proposed boundary amendment in written form filed with the Washington County clerk auditor, 197 E. Tabernacle St., St. George, Utah, 84770. All written protests must be filed by Oct. 19, 9 a.m. All withdrawals of a written protest or cancellations of withdrawals must also be filed in the same manner and by Oct. 19, 9 a.m.
If adopted, taxes upon all taxable property within the newly defined Hurricane Valley Fire Special Service District, also called Hurricane Valley Fire SSD, are subject to annual levying. Fees and charges are subject to imposition to pay for all or part of the services to be provided by the newly defined Hurricane Valley Fire SSD.
Any written protest made on behalf of any corporate-owned property sited within the proposed district shall be signed by the president, vice president or any authorized agent of the corporation. Any reasonable proof of a corporate officer’s or agent’s status with the corporation may be requested at the discretion of the county clerk auditor. Where property sited within the proposed district is legally owned by more than one person and/or entity, all owners holding legal title to the property must join in the signing of the protest in order for it to be considered in the calculation stated below.
The Washington County Commission is required by law to abandon the proposed boundary amendment if, by the filing deadline stated above, written protests are submitted by:
- Registered voters residing within Hurricane City equal in number to at least 25 percent of the number of votes cast in Hurricane City for the office of president of the United States at the most recent election, or
- Owners of private real property within Hurricane City that covers at least 25 percent of the total private land area within Hurricane City and is equal in value to at least 15 percent of the value of all private real property within Hurricane City.
Subsequent to the closing of the 60-day protest period, the Washington County Commission shall adopt a resolution either amending the boundary of the Hurricane Valley Fire SSD to include Hurricane City or abandoning the proposed amendment.
